NATIONAL AND INTERNATIONAL POWERS OF ATTORNEY

During their lifetime anyone, including business owners, can appoint someone trustworthy to protect their personal interests and/or professional assets when they are no longer able to do so. Known as a "power of attorney for future protection” (mandat de protection future), this type of power of attorney must be drafted with special care. That is why Bornhauser advises clients in these matters and helps them draft these powers of attorney.

We also advise our clients on drafting other powers of attorney, especially powers of attorney with posthumous effect (mandats à effet posthume), which are designed mainly for business owners and take effect on the date an ordinary power of attorney expires. Such powers of attorney may also be useful where there is a vulnerable heir (such as an adult under guardianship (tutelle)). 

The firm works closely with notaries to draft such powers of attorney.
